1. Acceptance of Terms

By accessing or using Dorevanti ("the Service"), operated by Smart Technology Investments LLC ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, you must not access or use the Service. We may update these terms at any time, and your continued use constitutes acceptance of any modifications.

2. Description of Service

Dorevanti provides aging-in-place versus facility care cost crossover analysis, including assisted living and nursing home cost comparison, Medicaid spend-down modeling, VA benefit stacking, ADL (Activities of Daily Living) decline projection, and long-term care planning tools. The Service uses publicly available data from CMS, Genworth, VA, state Medicaid agencies, and the Administration for Community Living.

3. Not Medical or Financial Advice

Dorevanti is an informational tool and does not constitute medical advice, elder care recommendations, or financial planning. We are not a licensed care provider, social worker, or financial advisor. Care costs, Medicaid eligibility rules, and VA benefit criteria vary by state and change frequently. You should consult a qualified elder law attorney, geriatric care manager, or financial planner before making long-term care decisions. No professional relationship is created by your use of this Service.

4. Intellectual Property

All content, algorithms, crossover models, and data compilations within the Service are the intellectual property of Smart Technology Investments LLC. You may not reverse engineer or extract the optimization logic. Reports are licensed to you for personal use and may not be resold or distributed commercially.

5. Acceptable Use

You agree to use the Service only for lawful purposes related to personal elder care planning. You may not use the Service to generate misleading care cost estimates for commercial solicitation or to facilitate Medicaid fraud. Automated scraping, credential sharing, and circumvention of rate limits are prohibited.

6. API Usage

Developer API access provides Layer 1 data including regional care costs, Medicaid asset limits, VA benefit rates, and ADL assessment benchmarks. Usage is subject to rate limits defined by your subscription tier. Redistribution of raw API data or use in competing products is prohibited.

7. Limitation of Liability

To the maximum extent permitted by law, Smart Technology Investments LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to inaccurate cost projections, Medicaid eligibility miscalculations, or care decisions made based on our analysis. Our total liability shall not exceed the fees you paid in the twelve months preceding the claim.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that facility costs, Medicaid thresholds, or VA benefit amounts are current or error-free. Elder care regulations and costs change frequently across jurisdictions.

9. Arbitration

Any dispute arising from these Terms or the Service shall be resolved by binding arbitration administered by JAMS in Los Angeles County, California. You waive your right to a jury trial and to participate in class action lawsuits. The arbitrator's decision shall be final and binding.

10. Governing Law

These Terms are governed by the laws of the State of California. Any litigation not subject to arbitration shall be brought exclusively in the courts of Los Angeles County, California.
